Pennsylvania Vape Ban: What's Legal, What's Gone, What to Do Before Oct 19
Bottom line: Starting October 19, 2026, Pennsylvania's Act 57 makes it illegal for any retailer to sell vape products not on the state's approved ENDS directory. Only 159 products from 6 manufacturers survive. That's roughly 95% of what vape shops currently stock. If you use disposables like Lost Mary, Geek Vape, or Raz, they're gone from PA shelves. Here's what's banned, what's still legal, and what to do.
Quick Takeaways
- 95% of vape inventory becomes illegal to sell overnight on October 19
- Only 6 manufacturers are approved: Juul, NJOY, R.J. Reynolds (Vuse), Blue Nine, Custom Technologies, and Schwartz (Naked 100)
- Fines start at $500 per unlisted product and escalate to $1,500 + license revocation
- Online sales of non-directory products to PA addresses are also banned
- Possession for personal use is not penalized — only sales are targeted
What Is the Pennsylvania Vape Ban (Act 57)?
Pennsylvania Act 57, signed by Governor Josh Shapiro in December 2025, establishes a mandatory state registry for all electronic nicotine delivery systems (ENDS). The law puts the Office of the Attorney General in charge of approving which vape manufacturers, brands, and flavors can be sold legally in the state pennsylvania vape registry law act 57.
To appear on the approved directory, a manufacturer must have marketed its products in the United States as of August 8, 2016, and submitted a product review to the FDA on or before September 9, 2020. This effectively limits the legal market to products with federal PMTA applications already under review or authorized pa s new vaping law takes effect oct 17 what consumers retailers need to know.
The bill's sponsor, State Representative Jeanne McNeill (D-Lehigh), said the measure is designed "to protect kids, support law-abiding retailers, and crack down on illegal vapor products." It passed the state House with bipartisan support, 147-56 .
Attorney General Dave Sunday confirmed that enforcement begins October 19 with targeted inspections of vape wholesalers and retailers across the state pennsylvania vape product directory enforcement begins october 19.

The Approved List: 6 Manufacturers, 159 Products
Only six companies cleared the state's certification process. Here's who made the cut and what they can sell.
| Manufacturer | Key Products | Flavors Available | Nicotine Strength |
|---|---|---|---|
| Juul Labs | Juul device + pods | Tobacco, Menthol | Up to 5% (50mg/ml) |
| NJoy (Altria) | NJoy Ace, NJoy Daily | Tobacco, Menthol | 2.4% - 6% |
| R.J. Reynolds (BAT) | Vuse Alto, Vuse Vibe | Tobacco, Menthol, Golden Tobacco | Up to 5% |
| Blue Nine | blu e-cigarettes | Tobacco, Menthol | Up to 4% |
| Custom Technologies | CrossBar Disposable | 4 flavors | 5% (50mg) |
| Schwartz E-Liquid | Naked 100 (10 flavors) | Fruit, tobacco, menthol | Up to 12mg/ml |
Notably, several of these manufacturers are owned by the largest tobacco companies in the world. Altria owns NJoy, British American Tobacco owns R.J. Reynolds Vapor Company, and Imperial Brands owns blu. The approved list reads like a who's-who of Big Tobacco's vape divisions .
Meanwhile, 23 additional manufacturers are pending certification, including Chinese companies like Shenzhen Smoore Technology and Shenzhen IVPS Technology. If approved, their products could re-enter the PA market in coming months pennsylvania ends directory.
How Enforcement Works
Starting October 19, the Attorney General's tobacco enforcement section, in collaboration with the Pennsylvania Department of Environmental Protection, will conduct targeted inspections. Retailers caught selling unlisted products face a tiered penalty structure.
| Violation (within 12 months) | Fine Per Unlisted Product | Additional Penalty |
|---|---|---|
| First | $500 | Product seizure + compliance warning |
| Second | $750 - $1,000 | Retail license suspension |
| Third | $1,000 - $1,500 | License revocation + destruction costs |
| Manufacturer | $1,000 per product | Separate from retail penalties |
Local district attorneys are also preparing to enforce the law. The Westmoreland County DA stated: "Our office has already proven that we will enforce vape shops to abide by the laws set forth, and we will continue to do so." Fayette County's DA indicated enforcement could involve periodic compliance checks and undercover operations pennsylvania vape registry law act 57.
Individual consumers who purchase or possess unlisted devices for personal use will not face fines. The law targets the supply chain, not end users pa s new vaping law takes effect oct 17 what consumers retailers need to know.
Impact on Vape Shops and Consumers
The Pennsylvania vape ban hits small businesses hardest. Gina Kipp, owner of Cool Vapes in Ross Township, told CBS Pittsburgh that 95% of her inventory will become illegal overnight. "I will probably have to close my stores after 12 years," she said .
James Wyckoff, manager of Mountain Vaporz, reported that unapproved products represent nearly 70% of his store's revenue. "Nothing that's been approved, we carry," he said. "That case, these two walls, all have to be bare" .
On Philadelphia's South Street, vape products account for 25% to 75% of store revenue. Several shop owners were unaware the law even existed. One store manager, who asked not to be identified, called it "monopolizing the market" and said customers are already planning trips to New Jersey .
Pennsylvania already imposes a 40% wholesale tax on vape products, one of the highest in the nation. Shop owners question how the state will recoup lost tax revenue when most products disappear from the market.

Alternatives for PA Vapers After the Ban
Option 1: Switch to an Approved Pod System
The three dominant approved products — Juul, Vuse Alto, and NJoy Ace — are pod-based systems available at convenience stores like Wawa. They come in tobacco and menthol flavors with up to 5% nicotine. If you currently use disposables, the transition to a pod system will feel different but delivers similar nicotine satisfaction.
Cost comparison: A Juul starter kit costs roughly $30-$50 with pods at $15-$20 per pack. Compare this to disposables at $12-$20 each, and the pod system becomes cheaper over 2-3 weeks. See our disposable vs refillable vape comparison for a detailed cost breakdown.
Option 2: Cross State Lines
Many PA vapers are planning trips to New Jersey, which does not have a product directory requirement. However, New Jersey enforces its own flavor ban, limiting vape sales to tobacco and menthol flavors only. The variety will still be wider than PA's 6-brand list, but you won't find fruit or dessert flavors legally.
Ohio and West Virginia do not currently have ENDS directories, making them alternative options for western PA residents willing to drive.
Option 3: Wait for Pending Approvals
Twenty-three manufacturers are currently in the pending certification queue, including major Chinese manufacturers. If approved, products from these brands could return to PA shelves in coming months. The AG's office updates the directory monthly. Check the official ENDS directory regularly.
Option 4: Explore Refillable Systems
If you're tired of the disposable cycle and regulatory whiplash, a refillable pod system offers long-term stability. You buy e-liquid separately and refill the pod yourself. While many e-liquid brands are currently banned, Naked 100 (10 approved flavors) remains legal. Our guide to the best refillable pod vapes of 2026 covers top-rated devices that work with separate e-liquid.

How PA Compares to Other State Vape Bans
Pennsylvania is not alone in implementing a vape product directory. Several states have already enacted similar registry systems, though the specifics vary significantly.
| State | Registry Type | Flavor Restrictions | Enforcement |
|---|---|---|---|
| Pennsylvania | ENDS directory (Act 57) | De facto via directory | Oct 19, 2026 — $500-$1,500 fines |
| California | Disposable ban (AB 762) | Flavor ban already in effect | Manufacturing ban Jan 2027, retail ban Jan 2028 |
| Virginia | ENDS directory | De facto via directory | Active since 2024 |
| Utah | ENDS directory | De facto via directory | Active |
| Wisconsin | ENDS directory | De facto via directory | Active |
| New Jersey | No directory | Flavor ban (tobacco/menthol only) | Active since 2020 |
California recently made headlines when Governor Newsom signed AB 762 on September 28, banning single-use, battery-powered vapes to fight plastic pollution. That ban takes effect for manufacturing on January 1, 2027 and retail sales on January 1, 2028 california disposable vape ban pollution newsom d1d559f571f7e13f38058b1a9fabc22a.
The pattern is clear: state-level vape restrictions are accelerating. For a national perspective on where vaping is heading, see our analysis of whether the US is banning vapes or our complete FDA-authorized vape product list.
