1. JUUL Will Pursue Broader Flavor and Nicotine Applications
CEO K.C. Crosthwaite explicitly stated the company will file PMTAs for "5% nicotine concentration products and a portfolio of flavors — beyond tobacco and menthol." Given that the FDA authorized mango (Glas Gold) and blueberry (Glas Sapphire) flavors in May 2026, JUUL has a clearer signal that non-tobacco/menthol flavors can pass the benefit-risk test. Expect filings within 6–12 months.
2. PMTA Review Times Will Continue to Shorten
The FDA's Center for Tobacco Products reported reducing its PMTA backlog by approximately 70% during 2025. The nicotine-pouch pilot program — which produced on! PLUS authorizations just three months after scientific review began — has been described as a PMTA review record. These efficiency measures are being applied to other PMTAs. The JUUL2 authorization, coming roughly three years after the initial 2023 filing, reflects this acceleration.
3. State Regulation Will Diverge Further
Even as the federal authorized product list grows, states are creating their own market-access layers. Key developments in September 2026:
- New York: 75% wholesale tax on nicotine pouches and alternative nicotine products took effect September 1, 2026, with a floor tax on existing inventory due September 21
- West Virginia: Vape Safety Act directory enforcement began September 1, 2026 — products not on the state list cannot be sold
- California: AB 762 banning single-use disposable vapes passed the legislature and awaits the Governor's signature
- Hawaii: New law requires FDA marketing granted orders (not just pending PMTAs) for state directory eligibility, effective for 2027
- Utah: 71% tax on e-cigarettes and 73% on non-pouch alternative nicotine products, with $1.00-per-can tax on pouches
The result: a product that is FDA-authorized may still be illegal to sell in multiple states. Manufacturers and retailers face a compliance landscape that is federally expanding but state-by-state contracting.
4. The Menthol Precedent Will Be Tested
The FDA's explicit determination that menthol's adult-switching benefit outweighs youth-appeal risk will be cited by other applicants. If future menthol or other flavor applications succeed using this framework, it could gradually open the authorized market to a wider range of flavors — but each application is reviewed on a product-specific basis, and there is no guarantee the JUUL2 reasoning will transfer automatically.
5. Nicotine Pouch Pipeline Will Expand
With 43 authorized nicotine-pouch products (20 ZYN + 6 on! PLUS + 4 additional on! + 11 ZYN ULTRA + 2 additional ZYN) and the PMTA pilot program accelerating reviews, the oral nicotine category is moving faster than e-cigarettes through the regulatory pipeline. New York's 75% wholesale tax on pouches (effective September 1) shows that states will tax this category aggressively even as the federal market expands.
