The 30% Section 301 tariff creates a significant cost differential. A device that costs $3 to manufacture in Shenzhen faces roughly $0.90 in tariff when imported through proper channels, adding to already substantial shipping, customs broker, and compliance costs. Gray market importers who bypass customs face none of these costs, creating a structural price advantage that enforcement has not closed.
Consumer Trends
CDC NYTS data shows youth e-cigarette use at 5.9% in 2024, down from 27.4% in 2018 — the lowest level in a decade. However, e-cigarettes remain the most commonly used tobacco product among youth who use tobacco. Nicotine pouches have become the second most common (1.8%), surpassing cigarettes (1.4%).
