Is every product from a well-known brand FDA-authorized?
No. FDA authorization is product-specific, not brand-wide. A brand might have one authorized SKU and twenty unauthorized ones. Always check each product individually.
If a product has a pending PMTA, can I sell it legally?
It depends. The May 2026 FDA enforcement guidance describes circumstances where the agency does not intend to prioritize enforcement against certain products with accepted-and-filed pending PMTAs. However, this is enforcement discretion — it is NOT legal authorization. The product remains technically unauthorized, and the policy can change. Some states may also prohibit sale of pending-PMTA products regardless of federal policy. Consult compliance counsel.
Does FDA facility registration mean products are approved?
No. "FDA registered" refers to facility or company registration, which is an administrative requirement. It is not product approval. Do not treat facility registration as evidence of product authorization.
Where is the most reliable source for FDA authorization information?
The FDA's official Searchable Tobacco Products Database and marketing orders pages are the gold standard. FDA has stated that its Searchable Tobacco Products Database is the current source for the latest information on legally marketable tobacco products.
How often should I update my compliance records?
FDA authorization status changes regularly. Set up a recurring review schedule — at minimum monthly, but ideally as soon as the FDA issues new orders. For new product listings, verify before each listing goes live.
Can FDA enforcement policies change?
Yes. The FDA has updated its enforcement priorities multiple times. The May 2026 guidance replaced earlier policy. Your compliance process should treat regulatory content as a live dataset, not a one-time check. Review and update regularly.
