November 12, 2026 will be remembered as the day the hemp party ended — at least for the high-THC segment. What started as a tiny loophole in the 2018 Farm Bill grew into a multi-billion-dollar industry that Congress eventually decided was too much.
For the nicotine vape industry, this is both a challenge and an opportunity. Vape shops that relied heavily on hemp revenue will struggle. But nicotine vape brands that are FDA-authorized stand to gain market share as consumers look for legal alternatives.
The most important thing for everyone — consumers, retailers, and brands — is to be prepared. Assume the law takes effect on schedule. Don't count on last-minute reprieves. Adapt now, and you'll be in a much better position on November 13.
We'll continue to cover this story as we approach the deadline. For the latest on vape regulation and market shifts, check out our state-by-state regulation guide and our Q4 market report.
