The hemp industry isn't going down without a fight. Multiple legal challenges are expected:
- Industry trade group lawsuits: The Hemp Industries Association, US Hemp Roundtable, and other groups have announced plans to sue. They argue the total-THC rule exceeds statutory authority and will cause catastrophic economic harm.
- State AG challenges: Attorneys general in major hemp-producing states (Kentucky, Colorado, Oregon) may file challenges on behalf of their states' hemp industries.
- Individual company suits: Major hemp brands are expected to file their own lawsuits.
- Congressional fixes: Some members of Congress from hemp states have already proposed amendments to soften the rule, though passage in a divided Congress is uncertain.
- Enforcement delay: Even if the law takes effect on schedule, actual enforcement might be delayed as the USDA and FDA work out implementation details and testing protocols.
⚠️ Important: Don't assume legal challenges will stop the law from taking effect. While lawsuits are likely, the Supreme Court has generally upheld Congress's authority to regulate controlled substances. Plan for the law to take effect on November 12 as scheduled, and hope for the best from legal challenges.
