Purpose

Texas has strict rules about which vapor products can be sold online. As an e-commerce operator, you're responsible for making sure every product you ship to Texas is legal. The problem is that the rules aren't in one place. You have to check multiple databases, and they change. This guide helps you set up a simple verification process so you don't accidentally sell something that's banned.

Inputs you need

Before you start checking, gather these things:

• Your Texas seller's permit number (from the Comptroller)
• Your DSHS registration number (if you've registered)
• A list of the specific vape products you sell, including brand and model names
• The manufacturer's information for each product

Having these on hand makes the checks faster.

Procedure

Step 1: Check the Texas Comptroller's vapor product directory

The Comptroller's office maintains a list of vapor products that are permitted for sale in Texas. This is your first check. Go to the Comptroller's website and find the vapor product search tool. Enter the product name or manufacturer. If the product isn't listed, it's not approved for sale in Texas. You cannot sell it to Texas residents, period.

Step 2: Verify your DSHS registration

Texas requires anyone who sells vapor products at retail to register with DSHS. This includes online sellers. Check the DSHS website to confirm your registration is active. If it's not, you need to register before selling anything else to Texas customers.

Step 3: Cross-check with FDA tobacco product listings

The FDA regulates tobacco products, including vapes. Products that aren't on the FDA's approved list might be subject to enforcement. While the FDA list doesn't directly stop you from selling in Texas, selling unapproved products can lead to federal trouble. Use the FDA's search tool to confirm each product you sell has the necessary authorization.

Step 4: Document your checks

Keep a record of when you checked each product, the results, and any notes. This documentation can prove you took reasonable steps to comply if you're ever questioned.

Outputs / success criteria

After completing these checks, you should have:

• A list of products that are confirmed as permitted in Texas and FDA-authorized
• Proof that your DSHS registration is current
• Documentation of your verification checks

If any product fails a check, you need to stop selling it to Texas customers immediately.

Exceptions

Some products might be exempt. For example, products that are not considered vapor products under Texas law, like certain CBD items, may not need to be on the Comptroller's list. But if you're unsure, contact the Comptroller's office or a legal professional. Don't guess.

Remember, this is not legal advice. Rules change, and your specific situation might have different requirements. Always consult official sources.

FAQ
